Fulfillment & Delivery Policy

1. Scope and Transaction Model
This Policy explains how fulfillment and delivery are coordinated for product transactions involving DMS Global Solution LLC. Depending on the transaction, DMS may be the seller or supplier of the product, or may provide sourcing, procurement, order-management, and/or fulfillment-coordination services.
The applicable quotation, invoice, order confirmation, or other transaction-specific documentation identifies the relevant role, products, destination, included services, pricing, and any specific delivery terms. Those terms supplement this Policy without limiting mandatory rights.
2. Independent Fulfillment Providers
DMS coordinates fulfillment through independent providers. Products may be stored, forwarded, transported, processed for customs purposes, or delivered by independent warehouses, forwarding providers, logistics operators, carriers, and delivery providers.
DMS, its owner, and its personnel do not physically receive or handle products, do not operate their own warehouses or transportation fleets, do not directly transport goods, and do not act as a carrier or freight forwarder.
Use of an independent provider does not automatically remove responsibility DMS may have. Responsibility depends on DMS's role in the transaction, the transaction documentation, the cause of an issue, and applicable mandatory law.
3. Review and Acceptance
Before accepting a transaction, DMS may review product characteristics, quantity, supplier, destination, route availability, operator restrictions, hazardous or restricted-goods requirements, customs considerations, and applicable regulation. DMS may reject a request that cannot reasonably be completed safely, legally, or operationally.
If a material fulfillment condition changes before DMS acquires or commits to acquire a product, DMS may issue a revised quotation, offer an alternative, or cancel the affected transaction and provide the applicable refund. DMS will not charge a higher price or use a material alternative without the customer's express acceptance.
4. Delivery Estimates and Delays
Fulfillment and delivery times are estimates unless DMS gives a specific written commitment for the relevant transaction. DMS does not guarantee timeframes controlled by independent providers.
Timing may be affected by factors such as:
- supplier availability or production time;
- warehouse processing and operator capacity;
- route changes, transport disruption, or weather;
- customs review, inspections, or authority action;
- destination restrictions, address issues, or recipient availability; and
- product characteristics, documentation requirements, or events outside reasonable control.
DMS will communicate material known delays and, where reasonably possible, a revised estimate or available options. Any mandatory right to agree a later date, cancel, obtain a refund, or receive another remedy for late or failed delivery remains available.
5. Tracking and Status Updates
Tracking information may be provided when the relevant supplier or independent operator makes it available. Tracking events, scans, and estimated arrival dates are generated or controlled by those third parties and may not update in real time.
DMS may communicate order and fulfillment milestones based on information received from the relevant parties, but does not guarantee the completeness or timing of third-party tracking systems.
6. Changes of Operator or Route
DMS may need to coordinate a different operator, route, service level, or handoff because of availability, restrictions, safety, compliance, capacity, destination requirements, or disruption.
DMS will not impose a material price increase or materially inferior alternative without the customer's express acceptance. Any material change and available alternatives will be handled under the transaction documentation and mandatory law.
7. Delivery Address and Recipient Information
The customer is responsible for providing an accurate, complete, and deliverable address and any recipient information or documentation reasonably required for fulfillment, customs, or delivery. The customer should promptly report an error before dispatch.
DMS will make reasonable efforts to pass a timely correction to the relevant operator, but cannot guarantee a change after processing or shipment has begun. A correction may affect timing or cost, subject to disclosure and applicable law.
8. Failed or Refused Delivery
If delivery fails because of an incorrect or incomplete address, recipient unavailability, failure to provide required information, or refusal of a conforming delivery without legal basis, the product may be held, returned, or redirected as permitted by the operator and applicable law.
DMS will review available options. Any cost allocated to the customer will be limited to actual and reasonable amounts attributable to the customer's or recipient's action, disclosed where required, and permitted by law. This does not apply to failure attributable to DMS or where mandatory law provides otherwise.
9. Inspection and Evidence
Customers should inspect the product and packaging within a reasonable time and contact DMS promptly about visible damage, shortage, incorrect goods, or other delivery issues. Where reasonably necessary, DMS may request photographs, video, packaging, labels, tracking details, and a description of the issue.
Customers should preserve relevant goods and packaging while a claim is reviewed where reasonably possible. Failure to inspect immediately does not waive rights relating to hidden defects or any right that cannot lawfully be waived.
10. Customs, Duties, and Taxes
Customs charges, duties, import taxes, and similar amounts may be handled differently depending on the transaction and destination.
If the quotation expressly states that an amount is included, it is included under that quotation's conditions. If it is not identified as included, it may be payable by the customer or recipient depending on the transaction, destination, and applicable law.
The customer or recipient must provide accurate information and documentation reasonably required for customs clearance or delivery. Authorities may inspect, delay, restrict, seize, or reject goods according to applicable law; DMS will communicate known issues and available options where reasonably possible.
11. Goods Rejected by an Operator or Authority
A supplier, warehouse, transport operator, delivery provider, customs authority, or other competent authority may reject or restrict a product or route because of safety, hazardous-goods rules, product characteristics, documentation, destination restrictions, capacity, or applicable regulation.
DMS may seek an alternative operator or route where reasonably available, offer a revised quotation or alternative, or cancel the affected transaction. Any additional price or material alternative requires the customer's express acceptance, and any refund will be determined under the Refund & Cancellation Policy and mandatory law.
12. Delay, Damage, Loss, or Missing Items
Contact DMS at info@dmsglobalsolution.com and provide reasonable supporting information where needed, which may include:
- the order, invoice, or quotation reference;
- tracking information;
- photographs or video;
- packaging and labels;
- a description of the affected product and issue; and
- any communication or record provided by the operator.
DMS will review the circumstances and may coordinate a trace, claim, or investigation with the supplier, warehouse, carrier, or other operator. Depending on DMS's role, the cause, evidence, transaction documentation, and applicable law, the solution may include continued performance, replacement, return, price reduction, refund, or another appropriate remedy.
Independent providers may have claims procedures and evidence requirements, but those procedures do not replace mandatory rights the customer may have against DMS when DMS is the seller or otherwise responsible under applicable law.
13. Returns
A return may require prior coordination so that the correct destination, operator, documentation, and handling instructions can be provided. Return-cost responsibility depends on the reason for return, prior disclosure, transaction documentation, DMS's role, and applicable mandatory law.
Products must not be returned to DMS's registered office unless DMS expressly provides that address as the authorized return address for the specific return.
When a return is applicable, DMS will provide the relevant return instructions and authorized return address.

14. Title, Risk, and Mandatory Rights
This Policy does not establish a universal point at which ownership or risk of loss passes. That issue depends on DMS's role, the agreed transaction terms, destination, delivery arrangement, and applicable law.
Nothing in this Policy excludes or limits mandatory consumer rights or remedies. An independent-provider handoff does not, by itself, waive those rights.
